I was given thirty minutes today in Allen Circuit Court on my request for declaratory relief and injunction. The hearing started late, and Mark GiaQuinta spoke for awhile, and I spoke, and GiaQuinta spoke and Andrew Swain spoke. Judge Thomas Felt issued his ruling of dismissal with prejudice at Plaintiff's costs.
The dismissal was based on the court's lack of subject matter. GiaQuinta argument was me not understanding the statute. My argument was not about a statute, it was about the failure to use the 2002 Assessor Manual. GiaQuinta discussed my stating the issue about assessing property as a simple matter was not to be treated so lightly because of it's impact on Fort Wayne Community School and the Mayor would not think it was a simple matter.
I reminder Counsel, that my children attended Fort Wayne Community School which more than likely his children did not or do not. I also stated that I still believe that it is a simple matter, city officials doing their jobs.
The Counsel from Indiana was unclear whether I was asking for proscriptive relief, which I was, but stated that I did not understand the meaning of uniform as it applied to taxes.
