IndyStar reports After the third time in the court to fight his death sentence, Zolo Agona Azania ended his stay on Indiana Department of Correction's death row in a Marion County courtroom under Judge Robert Altice, where he accepted a plea agreement for 74 years. Azania did not return to Fort Wayne where he appealed his death sentence imposed by Allen Court twice during the penalty phase of his sentencing. One appeal before the Indiana Supreme Court was for inadequate representation and the second for the improper exclusive of African-Americans from the jury pool by a computer system utilized by the courts of Allen County. In addition, two of Allen County judges were disqualified.
Azania has spent at least 26 years sentenced to death. Azania former known as, Rufus Lee Averhart, was charged with the death of Gary police officer, Lt. George Yaros. Azania, could see the light of day in 2019.
