Indiana Law Blog pointed us to Tom Goldstein reasoning for the lack of support for Judge Sonia Sotomayor. Judge Sotomayor has been labeled an activist and result oriented Justice-who goes beyond interpreting the rule of law. But soon say she is a stict constructionist who does not apply her personal opinions in her rulling but the law as established by the founding fathers.
But raced white women groups are throwing their support behind Judge Sonia Sotomayor. Sotomayor has been defined as latina and puerto rican. Nevertheless, Sotomayor is a Puerto Rican American born in New York, also referred to as Nuevarriqueños, appears to be a favorite.
Surprising in the fact, that Sotomayor does not represent family values epoused by conservative raced white women. Sotomayor is divorced and has no children. Nor the republican party that is supported by monied rich old raced white men who are not big women libbers.
But sisterhood has received to main blows to united women power, Sister Sarah Palin, from Alaska did not get the Vice President seat, so they have no choice but to take Judge Sotomayor as their flag waver. Even Sister Hillary Clinton was a dud for sisterhood.
With the loss of sisterhood to the highest seats of the United States, perhaps these groups do not want the Republicans to deny another opportunity for women to break the glass ceiling.
It's not like women have not been on the bench before. Justice Ruth Bader Ginsburg and Sandra Day O'Connor. Jurist Ginsburg is still there and O'Connor left, leaving Ginsburg as the sole female. However, Ginsburg is up in age and has several bout with cancer. This lone fact could explain why the sisterhood movement for Sotomayor.
But this does not explain a failure of a backlash from African-American women. Does nominating a female who is not raced white rises to the level of an African-American women sitting on the highest court? Or is President Obama cracking the door for the African-American female to just walk through the door.
