Unauthorized use of a person name or image

As a business person it surprises me that you make light of the use of your name as simply juvenile, especially with your training in journalism. Just let me share this with you, The Indiana Supreme Court takes a more stringent view, that such act constitute a violation of ones right to privacy. I can not use your name without your permission. Without your permission certain statements could be viewed as malicious and without legal privilege, which is similar to the journalist standard about public figures to put them in a bad light or harm their reputation.
In other words, that I can not go onto my blog and pretend to be Vince Robinson. I can not go write a comment on another blog sign your name and to give more credence to the signature linked the signature to your newspaper, INK.

Pray tell, what do you think the readers would think about your character and their decision in purchasing a subscription of your newspaper with such negative and vile comments attributed to you? Funny?

Or say I went online to recruit young children and signed your name and linked to your Newspaper, INK. Are you still finding it funny, if this individual intentional used your name once,( and as used others name) this individual has probably used your names and other individuals names places that only God knows where.

Juvenile? Innocent? This person intentionally hid behind your name. This person did not have the backbone and was unwilling to jeopardize his or her business, but thought nothing about jeopardizing your business. Still laughing? Think about when the global internet world type in your name and your newspaper those comments will be linked to the only African-American newspaper in Fort Wayne belonging to the one and only Vince Robinson. And that is you, not the person who made the comment. I don't know what else to say to get you to understand this is a liable act. I leave this case for you to read and hopefully you can see the connection.

Stop the domestic violence-- calling 911

This is interesting. Stay tuned. Just in time for O.J. Simpson appearing on Fox broadcasting network on November 27 & 29, 2006 to promote a book, which support the theme who does the public believe tend to believe in domestic violence cases.

Another Housing Nonprofit Investigation

The News-Sentinel reports that Fort Wayne's NeighborWorks accounting practices may have inadvertently placed funds in the wrong accounts. According to the story, a number of staff members have been suspended until further investigation as to how funding intended for Neighborhood Housing Services ended up in the account of NeigborWorks. NeighborWorks was formerly Rainbow Community, Inc and Project Renew until recently. NeighborWorks is a private not for profit organization. According to the article, a new employee discovered the alleged mistake. Interesting, that only after supposedly five weeks on the job, this new employee left the job, according to the article.

One thing that I don't understand is when an investigation is ongoing for African-Americans criminal charges the media shouts, but with raced whites there is no charges or criminal activity pending when wrongdoing is reported in the media, if it ever makes it to the media. This is not to excuse anyone's behavior, but too often board members who are responsible for oversight are hand picked in order to usurp accountability or to excuse the requirement of their fiduciary duties.

Still, it should not comes as no surprise that folks rarely see the fruition of a project meant to alleviate the condition of an impoverished area because huge amount of money has been diverted to unauthorized areas or to save profit making nonprofits.

And how many times must we fudge surprise upon learning that once again, the City of Fort Wayne is involved with such programs that are under scrutiny. NeigborWorks provided property for investors

and counseling services for low-moderate income families in the City's Renaissance Pointe (coming to your neighborhood soon) housing program

Do you ever wonder if the city's economic development programs are about just defrauding African-American citizens of their hard earned money?

Republicans gearing up for 2008

The Republicans are preparing to mend fences. Fences that is with the Latino population. According to the Washington Post, Mel Martinez has been named as Republican National Chairman. Failing to hold on to the conservative base, the Republican will need to capture some of the independent voters among the Latino community. Martinez was formerly appointed as the Secretary of Urban Housing and Development. Martinez is currently a United Senate for Florida.

Fort Wayne NAACP President Retain Seat

Rev. Michael Latham, executive director of Fort Wayne NAACP won his re-election bid for president. This election, according to a blog post by Vince Robinson, was a close one. Latham winning only by a slight margin. This could be membership sending a message to the NAACP leader, that the community expects more from the NAACP leadership.

According to an article in the Journal-Gazette, Latham took the high road and offered his contender an olive branch. In other words, Latham suggested that Robinson is needed in the organization. Latham is on the right track, the work of the membership is just as important as the networking that Latham is doing for the organization.

This was not a political election and Robinson should be commended for showing that if leadership is not going in the right direction it will be challenged. At times the election battle got ugly, which could have injured the organization. But instead it appears to have mobilized the membership in to action. That's a good thing.

In addition, the membership should be informed about any disagreements before the media is brought in. The membership pay to be told of any changes before contacting or granting headline grabbing attention getting moments in the media. The NAACP is made up of its membership not just of it's leader or political parties.

The Fort Wayne NAACP Election headed in a new direction?

Still waiting on the results of the local NAACP election. Let's hope so, but I'm not feeling it. I'm afraid we are going backward in Fort Wayne more toward this type of attitude.

What follows the November elections?

Taxes. No, I am not talking about property taxes, I am talking about the Federal Income Taxes. It is time to get your house in order. Time to start gathering all the expenditures and proof of dependents. Did you know your filing status and your ability to claim certain types of dependents could reduce your taxes or even entitle you to certain types of refundable tax credits? Well, it's your money and if you did not know some of these things, you need to ask somebody. And now is a good time to do so before the dreaded January 15 deadline.

Consolidation warmed over

Tonight at 5:58 p.m. at the Fort Wayne City Council meeting, it was apparent that the republican majority was gleeful in it election victory with a request by Sam Talarico to revisit the issue of consolidation with Allen County commissioners. Talarico, an at-large council member, suggested, with the support of several of his party members, to invite the three Allen County Commissioners to the City Council Table.

True to the current national republican form of governing, there is no plan and no plan is needed to share with the other members of city council before this meeting. The gleeful group is fully aware that they have the majority in both councils and any decision nay or yea is in their hands and not the democratic members. Is this not smug and arrogant really between the republicans member of both council? It is hoped by the republicans members of City Council that a compromised will be reached by at this meeting which is to be held before December 19, 2006.

Do the spoils go to the victorious party and not to the will of the people? Let's hope that the representative government rules over the tyrants.

More babbling from the Allen County-Fort Wayne Department of Health

In the latest tidbit from the newspaper, (although the free flowing from the mouth department head when they call a press conference for damage control is now not talking), is that the nine persons who were fired and replaced with the one and half staff members, more help is a coming. It has become apparent that the less is not necessary best theory is not working, three new hires will joint the one and half staff members. But you had to be able to think quickly on your feet to have figured that out. Quick thinking was not part of the covert operation to rid the department of employees in a plot that took nine months of planning, so it was reported. The newspaper headline screams three food inspectors will be hired !!! As a friend of mines says, Whoopee-doo !!

And if it was not bad enough that the media here , and here supported the action against folks who were more than likely not given their due process. The Allen County Council member Paul Moss and future Mayoral contender F. Nelson Peters commends the action, according to the newspaper's article, "County Council member Paul Moss, who serves as a liaison to the health department, also voiced his support for Waldron’s handling of disciplinary matters, as did County Commissioner Nelson Peters."

"Based on the probe’s findings, 'I think that … (it) is a step in the right direction,' Peters said last week, lauding Waldron’s management during a difficult time. Deserved or not, he added that terminations are hard on all involved, not least of which are employees and their families." (bold added)

But, its the other folks who clearly do not believe in nepotism or cronynism that should have the last word on this issue. What happen to ethical standard instead of self-interest? Oh I forgot Allen County is ran by a republican body, which believe in lying and staying the course in government even if a decision is wrongheaded. These folks were targeted.

I know, somewhere out there in Allen County folks believe public safety is an issue of concern with the Allen County Department of Health. Ha, it was and is all about them, saving their jobs from a possible scale back. I now fully understands why competent folks are beating the path out of the great progressive town of Fort Wayne.

There are laws against discrimination against the aged, disabled and ethic groups. There are laws against not following your companies policy and procedure and one can be found liable. Oh, and by the way can you volunteer time while on staff without liability issue involving when it involves government property,

"The investigation was prompted by calls from the public about employees not being where they were supposed to be, Waldron said"? Using her own money, she purchased three global positional system devices for about $250 each. She devoted an estimated 500 hours to reviewing movements of 16 employees – all when she was off work, she said."

What does Allen County government policies and procedures have to say about this covert operation? Hmmm, can anybody tell me?

Cybercrimes when blogging

It is interesting, reading, about the love of free speech and what our Constitution protects, what we call free speech. And yes we do want to express ourselves, but there are limitations on that first amendment right. Speech that is misleading, threatening, or rallying to do harm to a person is restricted by the government. So therefore, it makes sense that a business that is doing business on a globalized net work would quickly remove itself from participating in such restricted behavior. Because, the government does not like for commerce to be interfered with the Commerce Clause would be invoked to protect individuals from constitutional violations such, as discrimination, provided by the the 14th amendment in shepherding such businesses that do not comply.

Furthermore 2002, the Council of Europe made it illegal to incite hatred or discrimination through promoting or advocating such acts with publication or distribution of such materials on the Internet. The United States Constitution did not sign on because of its First Amendment protection of hate speech and were unwilling to endorse the addition to the treaty against cybercrimes. Nevertheless, with the United States allowing hate speech on the Internet,it weaken enforcement of other countries' citizens illegal actitivity. In other words, other countries citizens could use the sites of United States which are protected by the first amendment right.
so the problems becomes, if one country has the authority to ban and the other country not to ban,
where does the user prohibitive activity lands and did the user leave enough footprints or presence with the country banning the activity as legal issues. Which is huge jurisdiction mess.

Nevertheless, the United States government is not stupid and fully understands it has troubled folks using the the Internet and will not tolerate threats. According to the United State Supreme Court, "Protected hate speech falls away from its protection, however, when this speech becomes a "true threat" - any hate speech directed at a specific person in the form of a threat of abuse or violence. R.A.V. v. City of St. Paul, 505 U.S. 377, 393(1992). In addition, 18 U.S.C. 875(c) states that "whoever transmits in interstate or foreign commerce any communication containing any threat to kidnap or any threat to injure the person of another, shall be fined under this title or imprisoned not more than five years or both." See CAN YOU YAHOO!? THE INTERNET'S DIGITAL FENCES . The article goes on to say,
"[e]videntiary proof is required to show that a reasonable person would perceive the defendant's transmitted message as a serious expression of an intention to inflict bodily harm. In applying this law to messages sent on the Internet, a hate-laden message would have to be directed at a specific person and the message would have to contain a specific threat."

When naming an individual directly in print it becomes a threat to the person right to privacy, protected by the fourth amendment. In addition, because a threat is aimed at that person it should be enough to show intent by the user to inflict some type of harm. If the United States government and some of its citizens really believes in their war against terror, the Council of Europe treaty making it illegal for hate speech with threats on the Internet would be supported wholeheartedly.

And the rest of the story--Public Relation Tactic-Local Blogger has moved

No one knows why AWB is missing in Action, just speculation at this point. Some of his supporters have thrown out a tidbit, that he made some sex predator mad! But, it beginning to appears more and more like a feel sorry party. It's funny to me. There are lines one should never cross in dealing with folks, and AWB loved crossing them.

Some are suggesting it is the sexual predators, but veiled threats to other folks were made for just simply not agreeing with AWB outlook on life. The evidence is in the postings if you were smart enough to preserve them.

I was surprised by FWOB in supporting AWB right to type the many outrageous things and even publishing some depictions bordering on pornographic. AWB was supported by many folks in his wrongdoing, which was sad, because it spoke volumes to their toleration for hate speech.

It is one thing to think about killing a person, but when you speak or print out loud your hatred, or suggestion to others to cause harm. For one to craft plan and craft a blog, it's posting shows intent or actual malice.

People failed to understand you have limited first amendment rights..you don't have the right to yell fire in a crowded theater. AWB was supported by many folks who seeks leadership or are business people in the larger community and that was alarming to me.

You have the right to say whatever you want about me, but you better make sure it is within the law.

Evil does it's own self in....but it's not over. Do you think AWB is trying to repent? NOt

Rumbling of a Rumor

I received a telephone call that my harasser over at Fort Wayne News is down. Fort Wayne Observed suggested that, AWB received an email that is reporting him to the FBI and somebody's lawyer. Fort Wayne Observed suggested that AWB is no different from some others who do not agree with AWB in some of their comments. Indiana Blog Review hints it does not pay to sue bloggers.

I don't think it has anything to do with public record, but with the free willing personal attacks and I find it interesting, that Typepad does not agrees with Fort Wayne Observed with a written policy against hatemonger, see below:

Indiana Democrats 5 Republican 4

I don't care how much news coverage the republicans grab it is what it is. Read the thoughts of someone else on the Indiana races.

Come get your Political Signs?

Frank Gray has an article in the Journal-Gazette that these signs. According to the article there is no time limit on when these bad boys have to be removed. Some of the signs have already disappeared from my neighborhood but others are clustered together just waiting. I saw a lady today with about eight signs, when it dawned on me to ask her if she was headed to Jefferson Pointe. She stated she was going to try and get a few sandwiches from Chick-a-fil for herself and a neighbor. Chick-A-fil is offering sandwiches for signs. With some of the students being released, I mean let out of school early, parents should collects these times and treat the little ones to a great sandwich.

Microvote and the Infinity Machine

I could not mention the fact that I went to bed with Adams Township Assessor winner being Nina Gaines-Newson but from reading the next day reports Debbie Bearman-Thomas had taken the lead. Until to find sources confirming either of the results, I headed to Allen County Election Board . I was given four printouts. Four printouts because the results came from two different machines. So, to get the total I needed to add the two sets of numbers. This seems somewhat confusing and inconvenient to me for voters so seek certainty in their elections. The offical state certification of the votes do not happen until the week of the November 20th. Do we have any provisional ballots out there to be counted? Can we say Florida? I have so little faith in the voting process here in Allen County. Thank God for such a long weekend.

Nelson Peters is in as Allen County Republicans attempts to energize its base

The News-Sentinel reports that Nelson Peters will run for Mayor. Nelson will join Matthew Kelty in the primary race. Dr. Thomas Hayhurst does not appear interested in seeking the local office of Mayor. The Democrats will be hard pressed to find one well known personality to run against the two republicans.

Allen County and Government Efficiency

The voters have spoken on the lack of accountability of their elective leaders. The voters voted for a change in both the house and the senate after scandals that occurred under the old administration. Locally, for the status quo is worried and in order to maintain control a push for consolidation is in the works. Consolidation is hyped as cost-efficiency to cut back on waste and for streamlining government. Some cities opt for limited consolidation with simply consolidating departments to maximize its talents by cutting duplicity and increasing accountability.

But slackers in this restructuring of government will be not go away quietly. Fearing healthy competition, the status quo attempts other means in order to retain positions for their friends and family members. For example, Allen County recently issued a proposal to consolidate certain departments and this may have given folks in certain departments an ideal to protect their jobs. The Journal-Gazette provides a story about the housecleaning of staff members by Fort Wayne-Allen County Department of Health. According to the story, "GPS equipment [were] secretly placed in county cars by health department administrator Mindy Waldron, who led the investigation." In doing so, as many as six employees were terminated or resigned. The reasons were varied but one that stood out was that these employees were wasting taxpayers dollars.

This is interesting because, another story reported that the administrator supposedly purchased the GP devices, placed them randomly on County-owned vehicles, monitored the activities of county employees for over 500 hours over a nine-month period. Does this time period violate Allen County policy and procedure for an employee to notify law enforcement of criminal activity?

Another question, is an employee of the county allowed to work off the clock in conducting official county business? Another question why would an employee of the county spend her own money for an investigation on devices that were not authorized by the County? Another question if this was a random act in an investigation how was it that the devices captured nine employees of only two areas in the health department out of the 16 staff members? Another question why was there no coaching for corrective measures for those employees who had no previous disciplinary problems? Another question who is going to reimburse the taxpayers for the number of attorneys who sue the department for wrongful termination, invasion of privacy, and defamation of character?

To many questions, and how will those fired, retired, suspended workers be replaced read here in the New-Sentinel. Nine employees replaced with a part-timer and another employee with a different job title will step in to replace the director of another area. Makes you wonder, it only takes 1 1/2 persons to do the work of nine? Red Flags are all over this story. Ghost Employees, Felonies.....could there be more to the story?

Momma do you watch the news?

So stay the course, Bush partner in crime is stepping down, Secretary of Defense Donald Rumsfeld. My daughter calls to let me know. It's about time. But, after watching the blowfish females on Gannett Television suck up to the Allen County Republicans, yesterday, I was fed up with local news coverage.

Yeah, Yeah I know Melissa Long is married to David Long, Indiana Republican House of Representative. But Mr and Mrs. Long don't own the television station, Mrs. Long is only an employee. I would have loved to seen some of the Democrats who were winners have as much time or half as much time as the Republican winners.

So, I missed Rumsfeld stepping down, I would have loved to seen their face. After suffering a major defeat to their beloved KKK party, one of their fearless leader has exited stage right. So much for conservative values, folks are tired of lying republican you lost because the folks is tired of supporting the republican criminal rearends.

So daughter no I did not see Rumsfeld resign, but I'll be counting the days until the troops come home. In the meantime, listen to Julia Carson acceptance speech.

The African-American Vote Counts

Hello out there!! I know at lot of folks have not whispered this into either Souder or Hayhurst eye, but they need to get to some African-American churches come Sunday Morning. In the 3rd Congressional district there are over 32 % of female headed household. And many of these female headed house hold will be sitting on the church pew listening to the preacher preach a better day is coming.

You are not going to find your big donors there. But you don't need those donors now you need votes and one thing African-American women do is vote. So you didn't hear it from me, but those folks taking them polls probably didn't know this either.

Fort Wayne-Allen County Department of Health

The most surprising point of the story coming from the Fort Wayne-Allen County Department of Health is not that folks are being fired, but that more folks are not being fired for violations. I worked in this department as an independent contractor. Those who were left in charge were afraid of outsiders. As an independent contractor, they tried to order my steps and as most folks who will tell you ordering my steps does not come from incompetent folks. They wanted to oversee my creativity juices. They just did not understand I'm a free agent.

I was told that African-American women did not make it through the interview process because they dressed liked they were going to church with their flowery prints. Flowery dresses are better than jeans any day. They needed someone more professional looking. From me working with this group for a brief time looking at one wearing an Easter dress for a maternity dress or one just got out of bed look wardrobe, I think they should have been happy to see some sista dressed with pride. But, no, these women were competitive, and they did not won't educated sista up in their mix. I think the undercurrent of finding fault with the churchgoing women , was more than like these women would not work under the unethical work habits of these folks and would blow the whistle. Of course I was not a print wearing sista, but I still had ethic which explains why we parted company quickly and they paid.

Yes, you need to clean house Paul Moss and you just scratched the surface. And try to hire qualified folks instead of folks who like each other, you know the saying birds of the saying, corrupt together.

The real winners of the midterm elections

The real winner from doug's website is who ever gets the money spent in these campaigns.

TEd Haggard..Do it in the name of Jesus and you can justify in the end

Ted Haggard is giving new meaning to the hip-hop words..back that--- up.. Reports are stating that Haggard allegedly had a relationship with a male, Michael Jones. This would mean that not only does Haggard believe in male-female, (because he is married) but also in an occasional locker room boys only relationship. Haggard is reported to have stepped down as president of National Association of Evangelicals. Haggard is denying Jone accusation.

I know one thing for sure, it appears that a lot of fellows are in engaged in the down low.

Predictions still in the works.

My predictions are my educated guesses..I did not break down by groups or demographics. What I did was look at the elections for a number of years, looked at the turnout and decided how close and made a guess. Simple. My concerns for this midterm election are with voter apathy and the many voters who will not want to be hassled when they come to vote with having to show a picture ID. If I sign a statement, swearing that I am who I say I am, that should be good enough. I do expect a low turnout, and the small townships, I expect even lower turnouts so I did not take the time to guess, if I have time I may give some numbers.

It's your money-Property Tax overpayment-go get it

I talked about how crooked the process within the assessessment of property tax, that I can't see straight. To top it off, I go to Indianapundit and there is a mailer of Pat Love. But living here in the corrupt city, and believing a lie cannot live forever, here's some good news...the auditor office may owe you some money.

That's right, the auditor's office has decided to give back some of the money stolen from the taxpayers, or more political correct overpayment. I do not know how they decided who was to get what back, but I can bet my bottom dollar they kept more than what was given back.

Besides, it's an election year !!!!

And the winner is?

Predictions update**

Souder won with 59% of the vote in 2002 against an unknown; this year his opponent is known and only needs to get 12% of last year election voters. I would suggest Hayhurst rally all his opponents and ask them to have those who voted for them to give their vote to Hayhurst to pull this one off.

Hayhurst 34,000
Souder 30,000

District 15

Wyss is a legislator and not a meet and greet only type of guy and thus will win this one hands down.

Wyss 15000
Bynum 5000

Howell third time out should pay off in the republican influenced county, that is if his party truly supports him, if not GiaQuinta will win by default (name and did nohing to win this seat). Note interesting that two GiaQuinta are on the ballot, could the other well known GiaQuinta suggest to voters to vote for his brother?

Howell 7000
GiaQuinta 4000

James Ball (R) 7000
Maye L. Johnson (D) 3000

Council District 4
Calvert Miller (R)* 12,000

Summers is such a nice guy but won't win. Summers does not get the same type of exposure as McGauley who has switch position so much, you wonder is he just a floater,(did he not challenge Sandra Kennedy for a position) or does he just like seeing his name on the ballot.

John McGauley (R) 28,000
Herbert Summers (D) 20,000

Love won on a fluke had she fought for the taypayers, plain and simply neither, so Lopshire will win.

Just Waiting for somebody to offend me so I can have a reason why I voted for ( fill in the blank)

John Kerry has offended some folks. And because he has offended some folks, those folks are going to vote Republican. It does not surprise me. Just any old excuse to support evil. Otherwise, one would be hard pressed to understand why a group of idiots still supports George Bush who sent folks to fight a war based on a lie. A lie that President went on television and told the whole world. But you don't hear folks saying, I am going to vote as a Democrat or something else because George Bush lied.

Now let me see, if I got this straight. John Kerry warned students to do well in school or they may end up in Iraq and folks got mad, but young folks are dying in Iraq and folks are not mad? Let me repeat Kerry warn students do well in school, and Bush says stay the course in Iraq while 100 soldier died in October, 2006.

Or how about the republican man that was going around stalking young men for his pleasure, but these same folks are yelling, screaming we got family values. Come on people, get real. All these folks need is just one good reason not a plausible reason, just something to say I am a conservative and a conservative I'll die voting for no matter what. What the heck, conservative is just a word, you bright, articulate, and intelligent people !!!!!

Let see to keep students from going to war and you would vote R or D or I or anything but ?
