RANGOON/MAE LA (BosNewsLife)— There was hope Friday, August 3, for hundreds of Burmese refugees, many of them Christians, as the United States continued a « mass resettlement » effort, a major human rights group said.

US-based Christian Freedom International (CFI) said Bertha Say Dah and Mercy Htoo, two teenage girls from what it described as « war-ravaged Burma », also known as Myanmar, are among the refugees settling in the United States. The two learned English, computer skills, science and the Bible at a vocational school run by Christian Freedom International in the border town of Mae Sot in Thailand, not far from the Mae La refugee camp.

Fort Wayne Children's Summer Chess Tournament



The Fort Wayne Children's Summer Chess Tournament was held Saturday, August 4, 2007 at the Allen County Public Library Main Library Downtown. Children were invited to participate from preschool through those entering the fifth grade.

Children were rated starting with beginners, intermediate to advanced. All players who were United States Chess Federation rated players were required to play in the Advanced division. Those players who are rated travel and play in various chess tourney for rating and not just for fun. Jeremey Brune played a third round that seemed to go on and on....




Children in the Fort Wayne's Just for Fun tournament played five rounds with the winner receiving trophies and all players received a participation award. Alex Gaskill of Cedar Canyon won three out of five of his games. Girls played against boys, Lois Mamani won 2-3 of her chess games. Some children learned to play chess at their schools. Canterbury, Towles and Bunche were represented at the tourney. Kyaw T. Soe was the founder of the games at both Towles and Bunche, whom son Marco won with a perfect score.

Fort Wayne Unfair TAxation one woman campaign wins

Yes!!!

I had my hearing before the Allen County Property Tax Appeal Board on August 2, 2007. I took in my comparables and my listings. Of course they went to neighborhoods that were not my neighborhoods to prove me and to even increase my assessed values since I dared to open my mouth.


But, the fact of the matter is that today, Saturday August 4, 2007, the Board reduced my assessed value. Yep, it was an ugly battle within a short time span that I did not want to do but had to do.

They reduced the assessed value of the house and increased the value of the land.

These people....just do the right thing.

Folks you need to file your appeals and get it in writing.

People are appealing and they are not changing the information that is online.

Several individuals I know property cards have been changed and you will not find those changes by going to the News-Sentinel site listing the tax information.

The Allen County Property Tax Appeal Board

This is an interesting group of people. I suggest you go and sit in on an appeal of local property tax. I went before the board yesterday. I had went before the board in 2003, the first year I returned to the city. So, from my first experience, I knew what to expect from the group. This time was somewhat better. Mr Thistlewaite, appeared to know what is required and asked the right questions. The assessor officials of course do not want to be proven wrong, so they will lie through their teeth. Sorry, but it's a fact.

Remember, these are some of the same officials who were changing figures on their own property record card before the election !!! Oh you forgot, and for those of you who want to pretend that this year property assessment is the fault of last year administration, let me remind you both Bev Zuber and Stacey O'Day worked in the assessors office before taking on their leadership position. Forgot that too, huh?!

After explaining my neighborhood and connecting neighborhoods experienced little home sales, it was no surprise that the Board was blown away with the assessment of this home only 6 blocks away, but valued at $161,000.00. More proof that it is a hit and miss tactic that is used by those who are cooking the number in the assessors offices in Allen County.

How much is that suite overlooking the ballpark?

The answer to the question would have to come from the individual or individuals who lease one of those puppies. Jason Freier stated they were all gone. Matter of fact, the originally twelve went so quick that four additional suites were added. But, from the increased interest of the twenty year lease has driven the total number of suites from sixteen to twenty.

Let's guess at $20,000 a piece, the twenty would bring at least minimum of $4 million dollars. Not one ticket to the ballgame has been sold, and it appears that Freier is on his way to capturing his initial investment, wouldn't you think?

Sweet.

For Freier and company, I would think.

Now there is the condos. The marketing of the condos at the open house makes me think that, those puppies are still just sitting in the windows. It was rumored that there was at least ten sold and perhaps a potential of thirty more buyers from the folks who were in attendance at the open house.

Now many of the folks were city workers. Yep, folks who were connected to the project. These folks are good as stage extras, you know the folks who fill in for the real people.

Nevertheless, I missed seeing at least one gloating member of the city and one concerned citizen from the open house, both will remain nameless.

Benjamin Lanka, must have been overwhelmed with his positive spin for the Harrison Square Project that he missed Boni. Boni was determined to let Jason Freier,Deputy Mayor Mark Becker, and anyone else at the open house know that she was not happy with the way her tax dollars were being spent.

Boni was more upfront about the matter than those who werein the hallway talking about their discontent about the project or those along the wall (out of earshot of Ben Lanka, of course, positive story so as not to embarrass the Mayor).

Objective? It's hard to be when it's your friends.

But Freier promised Boni that he would not bring in a strip club. The Mayor did not promise, Greg Leatherman did not promise...

American Home Mortgage Investment Corporation shuts down

Financially troubled American Home Mortgage Investment Corp. will close for good today, putting about 155 employees in Fort Wayne out of work, the Journal Gazette reports today.
The Melville, N.Y.-based company declared bankruptcy Thursday and senior management said its employee base will be reduced from over 7,000 to approximately 750. The company currently is maintaining its thrift and servicing businesses.
Deborah Sturges, founder of Fort Wayne-based Hallmark Home Mortgage, told the Journal Gazette she heard from numerous former co-workers who received an e-mail from American Home Mortgage founder Michael Strauss confirming the layoffs.
Local employees had already been told to remove their personal belongings from the office, Sturges said. The workers’ last paycheck will be dated Aug. 10, she said. Sturges wasn’t sure whether employees will be paid for next week or whether the company’s payroll cycle has a one-week delay.

Michael Strauss, American Home's Chief Executive Officer, stated on the company's website: "It is with great sadness that American Home has had to take this action which involves so many dedicated employees. The employees affected should understand that this is not a reflection on their efforts or their productivity. Unfortunately, the market conditions in both the secondary mortgage market as well as the national real estate market have deteriorated to the point that we have no realistic alternative." Marion County Assessment is void

It is official, tax payers in Marion County will pay taxes at the 2006 rate.

As used in this article, "captured assessment" means the amount of allocation area assessment used to calucate the tax increment.

Ben Lanka writes in his article Harrison Square Turns on Mall Tax, "Tax increment districts capture property taxes generated by development within the district."

20 Indiana Administrative Code 2-1-20 As used in this article, "tax increment" means the property taxes generated from the captured assessment.


Nowhere does it says development but area, but it does say:

Sec. 1. This rule applies to the establishment of allocation areas by redevelopment commissions and to the generation and use of tax increment in those areas. The following subject areas will be addressed by these rules:
(1) Section 2 of this rule addresses the designation of the geographical boundaries of an allocation area by the redevelopment commission, the findings that must be made before an allocation area is designated, and the determination whether the program
includes allocation area personal property.

2) Section 3 of this rule addresses the effect on the base assessment of a change of the size of an allocation area or a change of the base assessment date.

Allen County Auditor LIz Blosser was on the news today showing her dumbness about property tax relief. The State of Indiana wants to extend the homestead credit application deadline until SEPTEMBER of this year. GET to writing folks, just get to writing and tell a friend, or Paul Moss. I am calling Jeff Newmeyer of Indiana Newscenter in about 15 minutes.

If you build it they will come

These folks are located on Wayne Trace. They are building homes, not one at a time for folks in the African-American community. This is a positive. You don't hear much about this because they are not out stealing property under constructive eminent domain like the redevelopment commission or Mayor Dick.

Just because an opinion was offered (according to the highlighted article) that a criminal action did not happen does not mean that it did not. It only means that the limited information that was available did not rise to the level of a criminal investigagion. I think if the Indiana Department of Local Government Finance begins an investigation into the use of funds outside the Jefferson Pointe District, criminal charges would likely follow. There was a reason why they called it Jefferson Pointe TIF district rather than Harrison Square TIF district.

I think JOhn Kalb should write a letter and provide the Indiana Department of Local Government Finance and Governor Mitch Daniels the outcome would calls for further investigation.

What happens to Republicans stays with Republicans or is "handled differently"

See, Allen County Sheriff Ken Fries when officers are allowed to treat some folks differently, than it does not take them long before they begin to think they should be allowed special treatment. I'm just saying, action teaches the young how to take on their own responsibility..read the story for yourself.

The wife of Allen County Sheriff’s Department spokesman Steve Stone was arrested early Monday on charges of operating a motor vehicle while intoxicated and appeared in Huntington Superior Court later in the morning. While Huntington County sheriff’s deputy David McVoy was taking Stone’s wife into custody, Stone repeatedly asked him to “handle (it) differently,” the police report said.

And while Huntington County jail officers were preparing paperwork for a blood test to determine her level of intoxication, several Allen County deputies called the jail. Some of the calls were “not very friendly,” according to a police report, which does not identify the officers that called.

Stone described his statements as the “excited utterances” of a concerned husband as he watched his wife being handcuffed and put in the back of a police car.

Monday evening, Fries said he will conduct an internal investigation into the officers’ behavior.

State gets tough with County Assessors

There's a new sheriff in town and she's called Cheryl Musgrave over at the Indiana Department of Lcoal Finance.
County assessors across the region, under pressure to get overdue property tax information to the state, say they are doing their best to get the job done but that there are good reasons the data is late.


UPDATE:

The DLGF is requesting a list of dates, times, and locations of all local budget hearings, or notification of these hearings a minimum of seven days prior to their scheduled dates.

If Allen County does not get the data to the DLGF some things could happen:

1. All property tax replacement credit (PTRC) distributions from the state to the county unit of government will be withheld until Allen County becomes fully compliant. OOOOOOH, this will bite, because the County will not get this money.

2. DLGF will hold the 2008 Budget order to the county auditor until Allen County become fully compliant. This action affects all taxing units. No budgets will be approved as a result of data incompliance. Ouch..no budget for nobody.

3. Legal action may result to enforce the law against the responsible officials, the County auditor and County assessor. Yep, it's getting ugly.

4. Sales disclosure data sets for 2006 sales will not be reviewed until all 06 pay 07 datasets are compliant.

5. Ratio studies submitted for approval for 2007 assessments will not be reviewed until the 2006 sales disclosure dataset is compliant.

6. DLGF will not approve any bond order for any unit of government within the county until county datasets are compliants.

Well, City Council Members?

Well the dissenting voices from city council have fired off a letter about the rush to close the Harrison Square Park deal. Now what?

For many the highlight of the Fall Housing Summit will start at 4 p.m. when the DID will unveil locations participating in the first-ever Fort Wayne Downtown Loft Housing Competition. Architects will present renderings of the six units to be developed over the winter, and there will be a tour of the raw spaces so participants in the summit can see the spaces before work commences.

Finally, a last minute treat has been added to the agenda. Scott and Melissa Glaze have partnered with Tym DeSanto, one of the finalists of HGTV’s Design Star show and Fort Wayne native, to renovate one of the lofts in a building on West Wayne Street.

Scott Glaze is the chairman and CEO of Fort Wayne Metals Research Products Corp. Glaze became president of Fort Wayne Metals in 1985. The company has since grown from one facility employing 30 people to five facilities with more than 350 employees in Indiana and Ireland. Fort Wayne Metals has become the world leader in its field.

Glaze has been a member of the medical device committees of ASTM and ISO and has written numerous national and international standards for medical materials. His professional experience also includes Quoin Enterprises LLC and LABECA LLC. Glaze is a member of ASTM International, American Society of Materials, and Wire Association International.

Glaze's community involvement includes serving as the director of the Indiana State Chamber of Commerce and the Economic Development Alliance, secretary of the Northeast Indiana Corporate Council, and member of the Purdue Ciber Advisory Council.

the three dissenting voices on stolen land

Did you read this post, City council men I wrote this a while ago.
Spring taxes delayed, says the News Sentinel. I reported Saturday that you would receive your tax bill in the mail in June. But, Robert Lee states, that I am wrong. That the bill that you should have received in MARCH, you will receive in JULY. But you will still have the NOVEMBER DATE FOR THE SECOND HALF.



Allen County Treasurer Robert Lee announced that spring taxes will be delayed this year because of adjustments to property values. This is the first time the adjustment has been implemented in Indiana, joining 48 other states.


Yeah right, the first time, my behind. The first time the adjustment is called trending. Remember all those computer glitches, instead of saying oops no we did not go out and assess all these properties in the proper manner.


However, Lee has started a property tax e-mail system to keep taxpayers updated on when tax amounts are in and when they are due. Register at www.allencounty.us/treasurer.Tax bills are expected to be ready the beginning of July.



I found that gem in the police brief in the newspaper. Right there in the criminal section of our newspaper, what a fitting place to locate such news for our taxpayers. Go see for yourself, I am not making this stuff up. Do you really want these folks to have your email address? These are the same folks who did not send a man a certified letter and his property was sold. Property sold at a tax sale. I don't think email is a good way of communicating with these folks.

Now the big question for me is why are our property tax bill so late? I know what Lee says, but I have my doubts. And it all points to this Harrison Square Park deal. It may be just me, but I suspect they have not priced the property for Jason and Chris. You know our friends at Hardball Capital. Because, the price of that property will determine how much taxes Hardball will have to pay for those condos. And it will determine how much will go into that special fund, TIF.

You know the fund, Jefferson Pointe TIF expansion. TIF will freeze the amount that Jason and Chris will have to pay on taxes. Had you ever played the game Freeze. Well that is exactly what is going to happen to the land, that Greg Leatherman, is now trying to do a better job of assessing.

You probably read where Leatherman, stated that he probably overpaid Bill Palace, $2.4 million dollars on property valued at a little over $600,000. Now Leatherman could probably play Mr. Big Spender with taxpayers dollars. But Jason and Chris, our friends, because we are so happy that they are spending $5 million and $15 million more on condos. I don't think Jason and Chris are going to spend an extra penny on over assessed property.

Yeah, I'm thinking that's what happened. Because, when have you known Leatherman, or any elected official, to admit they made a mistake? So, everybody should have went to their window, and saw all that snow falling, and thought it was an indication, that something is not right.

Anyways, back to TIF and our late tax bills from Robert Lee and friends. As you know City Council has not approved the extension of TIF yet. So if our friends, Jason and Chris, want to take advantage of this reassessment they need to move locking in the current value of their downtown investment. As soon as Chris and Jason sign the agreements surrounding property is going to skyrocket. But those who are already in the TIF designation is going to be protected from increases in their tax burden each and every business that's in the area. Nope, no new taxes. It is all the folks who comes in afterward. Yep, Hardball is to be the CATALYST to all these new businesses. Businesses drawn to greatness, the field of dreams. You know the saying about if you can't be a mountain, at least attach yourself to one. But you knew that, I'm not telling you nothing you didn't already know.

Why do you think Leatherman and his cliche are running around recalculating figures on land already sold ?!! They, city leaders, have not told you the value of the property for our friends, Jason or Chris. They can tell you everything else. They can tell you projection 20 years out. But they are scratching their heads on the value of that land that, you know the land they already bought by secretly going knocking on folks doors. Did not even tell City Council.

So, my theory is our tax bills are being delayed because we are waiting on our new neighbors. Our friends, Chris and Jason's property to be properly assessed. There is another saying, that you can fool some of the people some of the times, but you can't fool all the people all the time. I think our friends Chris and Jason are teaching our Room for Dreams city that very lesson. I could be wrong.


One of my readers said I sit on a throne of lies. He recently came over and apologized. He also told me he was impressed. But, this blog is all about recognizing, if you don't know you need to ask somebody. And if folks ask, tell them FWAAIW, told you so.

Predominate Use

"But donors don't want to fund good causes, they want to fund effective ones. The Community Foundation of Greater Fort Wayne, for example, receives four to five times the number of requests it is able to grant, according to Executive Director David Bennett.

“Clearly, it's a very competitive process,” he said. “Lots of projects don't get funding. ... good ones. We read many applications from very, very worthwhile projects in the community.”, according to an article in the newspaper.


I posted an earlier post about an organization called Rialto Theatr, INc. which is a furniture store called Finders Keepers. And its's neighbor is a nonprofit called Reclamation Project. With all the renovation I confused the two organization, and I apologize.

However, we know that taxes should be made on the part of the building that is not being used for it's purpose. We know that the cigar and tobacco part of the building is the smallest part of the building is being used, so why is the other part not being taxed that is not being used for its purpose?

The city must decide by the end of the year whether to exercise its $25,000 option and buy the land for North River project at $4.3 million reports the newspaper. If spending the taxpayers dollars for Harrison Square deal was not enough, the City has enough money left over from the kitty to buy more land. And they are over assessed to collect even more money from that taxpayers who did not complain.

Gianni Longo has been brought back to town to get input from the public on the new design for the North River Project. Longo does not know that the majority of the folks who participate in these meetings work for the Mayor or have an investment in the Project .

I happen to sit in on one of the meeting, and I spoke to only a handful of the citizens who were not being paid to be at these meetings. So much for public input, Mr. Longo.

Bloggers learn they are just puppets for City Council Members

Quite a few bloggers showed up for the July 25, 2007 City Council meeting. It was obvious that some of the bloggers had not been to a meeting in awhile, when it was discovered that the meeting was held in a tiny room unable to accommodate any large group attending the meeting.

Some bloggers were unable to enter the meeting, because the seating was filled with the very important people. The very important people, as expressed to one member of the public was the justification for blocking off rows of seats on one side of the room. The real reason is that these very important people do not like sitting with the common folks, just in case a shot is fired in the group. The media learned that they are not very important people because they are not allowed to sit and talk with the very important people. But to insure that the media write about the very important people, a section on the opposite side of the very important people was reserved for the media.

Now, if some of the commoners, better known as the public citizen should happen to think that they can sit whereever they dang gone please, security is there to ensure the commoner get the message to sit behind the very important people or else! The or else can range from getting yelled at, told to move, took to leave the room, anything to make you feel you are not welcomed at the City Council Meeting period.

So bloggers, did not like the treatment of the "they better get to stepping or risk getting kicked out the room from witnessing the master and slave sitting arrangement."

But the real issues suffered little outrage from the bloggers, the call for reassessment and the millions of dollars going toward Hardball Capital. What was important to the blogger was the fact that they were treated no different than the original citizens who don't have an inside track to the elected officials.

Something, I've been complaining about for quite a long time. But these elected officials who sanctioned this arrangement will gladly listen to the bloggers complain after the meeting.

Let's see the solution to that problem is to vote the SOB's out! Is SOB the same as VIP?

The County Property Tax Assessment Board of Appeals

Today the County Property Tax Assessment Board of Appeals listened to Amos Bauman, Diana Kruse, Ronald Guingrich, Michael Olson, Dewald Property Tax Services, and several others. I will be going before the Board on August 2, 2007. I decided to listen in on the hearings to update myself on any new information. There was one testimony, by Olson that was very informative, it appears that property in that area is flooded which would impact their selling price. The selling price would impact the assessment value determined by the assessor's office. An appraiser helped the Olson family out in this case and Olson's petition was granted to lower his property to $75,000.

However, an appraiser is not mandatory for appealing your assessment, only evidence that a buyer would not purchase your home based on assessed value, and now Mr. Olson's home can be used as an comparable tp prove that point, if homes are having similiar problems in that area. Appraisers are given more weight at the hearing because they work hand and hand with the real estate market and are generally known by one another. They speak the language more so than a lot of attorneys. In addition, the appraiser is doing what the assessors are required to do in the first place. This saves the assessors time and money from not having to hire a more qualified staff in the assessors' office.

Of course, I had to talk to the folks who were challenging their assessment, and to ask them to send letters to the Department of Local Government Finance. This action alone was enough to offend some folks, and one member of the board decided to accuse me of trying to take her picture after a brief recess. It was a cellphone that had the female in uproar, or it was just my mere challenging presence in the room. But, it does not say anything about a person has to be liked to attend a public hearing, or did I miss that somewhere in the course on how to conduct yourself when in the presence of those who view you as a wild hair up their rear end?

Here is some of the information that I am aware of when filing an appeal on property assessment.

The County Property Tax Assessment Board of Appeals (PTABOA)is a body of folks who listen to appeals about your property assessment. An objective appeal is the form 133. A more subjective appeal is covered under 130 or the form provided by the assessor office, I prefer form 130, but they are hard to find. In filing any of these appeals time is of the essence.

CORRECTION OF ERRORS (Form 133) - If an objective discrepancy exists that requires correction, this form is filed with the County Auditor. If an error is discovered you can go back three years for a refund. You will need to file Form 17T for the refund and will be required to show proof of payment of the tax bills from the prior years.

APPEAL OF PROPERTY TAX ASSESSMENT (Form 130 or the form provided by your assessor) - If you can not get the assessor to informally correct your property assessment you can file an appeal to the PTABOA . Within 45 days on the tax bill (not the date that you received the tax bill in the mail )from the Township Assessor, a form(or Form 130) must be filed with the Township Assessor and the County Assessor demanding an appeal. Remember to keep a copy of the request for an appeal.

A hearing with be held before the of PTABOA or Small Claims Court. The Small Claims Court is new this year. You will be required to present evidence and or witnesses to prove the assessment was incorrect. You will be required to provide the county assessor office copies of your evidence and witnesses. On the day of your hearing, you will be required to provide at least eight copies of the information that you will presence to the PTABOA. That's correct eight copies, one for each member of the Board.

The members are Kim Klerner, Dave Meyers, Stacey O'Day, Judy Macon, Ben GiaQuinta, John Thistlethwaite, and John Roger. Several of these folks work in the County Assessor office.


PETITION TO THE INDIANA BOARD OF TAX REVIEW (Form 131) - A determination will be sent to the taxpayer and the Township Assessor by the Property Tax Assessment Board of Appeals. Either party may request a review by the Indiana Board of Tax Review by filing a Form 131 with the County Assessor within 30 days of receipt of the determination.


PETITION TO THE STATE TAX COURT - Once the Indiana Board of Tax Review gives notice of its determination, the petitioner may seek a review by the Tax Court by petitioning the court with 45 days of the determination. A copy of the appeal should be filed with the Attorney General and the County Assessor in the county in which the property is located.


Hopefully, I can upload some of the testimonies from the hearing later.

The Smokers are planning a revolt

If the Harrison Square Park Project funding is not enough to fill the City Council meeting, if the increase in property tax is not enough to fill the room, if the firefighters wanting to define their own destiny, well surely the smokers will do the trick at Tuesday's City Council Meeting.

"The bigger the crowd at Tuesday night's City Council meeting, the better the chance the city's smoking ban will be amended or repealed. At least that's what local bar owners and sympathizers said Monday afternoon.

“I'd expect 2,000 to 3,000 people,” said Mikeal Vaughn, a representative with the Indiana Niteclub Association, who hopes to overwhelm council with numbers.

The push marks the latest effort by bar owners, smokers and some nonsmokers to amend the city's ban on smoking in enclosed public places - including restaurants and bars. One possibility floated by bar owners would be to exempt establishments admitting only people 21 and older.

Since the ban took effect June 1, bar owners contend they've seen profits fall drastically, and some have had to close their doors. Jeff Briley, owner of Bogey's Bar and Grill, 1567 W. Dupont Road, said he paid $1,000 less in sales tax to the government in June compared to last year because of the ordinance. He estimates that equates to about $15,000 that didn't go into his cash registers.

“I've heard people say ‘Smokers don't vote.' Well, we're going to turn that fact into a myth,” Briley said.

Vaughn said if council isn't receptive to their appeal, he will host a meeting Wednesday night at Piere's, 5629 St. Joe Road, to endorse candidates for November's election.

“If they don't do something soon, we'll tell them what to do in November,” said Jon Bartels, vice chair of the Libertarian Party of Allen County and a candidate for the City Council 2nd District seat.

The Department of Local Government Finance has adopted rules establishing a system for annually adjusting the assessed value of real property to account for changes in value in those years since a general reassessment of property last took effect under Indiana Code 6-1.1-4-4.5 (a). The system must be applied to adjust assessed values beginning with the 2006 assessment date and each year thereafter that is not a year in which a reassessment becomes effective.

The objective to the system is to promote uniform and equal assessment of real property within and across classifications. This system is to be used by assessing officials with certain specifications adopted by the Department of Local Government Finance

This petition is a request for the Department of Local Government Finance to investigate the annual assessment of the real property in Wayne Township and Aboite Township because assessors have failed to follow the rules established under Indiana Code 6-1.1-4.4.5.

This petition request that an order be made to Governor Mitch Daniels for resolution upon DLGF’s finding on whether or not these guidelines and those found in the Indiana Administrative Code for an annual adjustment were followed to the specifications adopted by the Department of Local Government Finance.

The methodology of willy-nilly selecting and using various property record cards from various neighborhood with assessed values that were not based on trending but from an earlier faulty methodology is not one of the method used for assessing property to insure and maintain a just and equitable valuation of real property. There are three generally accepted techniques to calculate market value in use, the cost approach, the sales comparison approach, and the income approach, which are incorporated by reference in article 21 of the Indiana Administrative Code. The arbitrarily and capricious selection of property record cards and not sales disclosure is not one of the three techniques listed.

The purpose of the article is to establish procedures to govern local assessing officials and the department of local government finance in the annual adjustment of assessed valuations of real property under Indiana code. The department of local government finance may adopt a resolution declaring its belief that it is necessary to reassess all or a portion of the real property located within the State of Indiana if the procedures, procedural requirements, and standards established by this article will ensure that the annual assessed valuations are reflective of current market values in use conditions

That fact is the Department of Local Government Finance is charged with maintaining a just and equitable valuation of real property throughout the State of Indiana. This is an emergency where the accuracy of the assessment of real property is an indispensable requirement for a fair and equitable system of property taxation of property wealth and does not become a forced contribute of dollars demanded by an overspending government.


This petition includes a request for the order to freeze the current property tax due at the amount of the 2006 tax bill fees until the reassessment has been completed for real property situated within Wayne Township and other similar affected townships in Allen County.

Governor Daniels Government Streamline Team

Gov. Mitch Daniels has created his own blue ribbon team for streamlining local government structure. This is an interesting turn of event, when soon local government were seeking home rule. After 2006 annual assessment of property taxes went wild, Gov. Daniels has appointed co-chairs, former Democratic Gov. Joe Kernan and state Supreme Court Chief Justice Randall Shepard. Louis Mahern, a former Democratic state senator from Indianapolis; Ian M. Rolland, a retired Lincoln Financial Group CEO from Fort Wayne;
undefinedJohn Stafford, director of the Community Research Institute at Indiana University-Purdue University Fort Wayne, Indiana; former Indiana University President Adam Herbert, Indiana; and the lone female, former Secretary of State Sue Anne Gilroy will be members of the committee.


It is interesting to see Ian M. Rolland a part of this committee. Rolland was instrumental in saving a lot of the housing stock in the core of the central city. Rolland was part of a group that started the Lincoln Live Improved Housing. Many of these homes were rehabilitated that were such disrepair they were going to be torn down. The area were these homes are located are now being overassessed under the 2007 annual trending.

Three other members will be selected to join the committee. Hopefully, David Bennett will be added to this group. Bennett was a former tax watchdog in Fort Wayne. Bennett has written Financing Local Government in Indiana, Guide to Indiana Taxes, Uniform and equal : Why the Courts Overturned Indiana's Property Tax System--and What Happens Next along with some other books. Bennett is currently Executive Director of the Community Foundation of Greater Fort Wayne.

It's Official the Republicans endorsed Matt Kelty

Or should I say that some Republicans endorsed Republican mayoral candidate Matt Kelty. United States Representative Mark Souder, R-3rd District, threw his support behind Matt Kelty along with Allen County Republican Chair Steve Shine wearing a Matt Kelty button, just in case there was any doubt about his support for Kelty. Mitch Harper was introduced at the podium.

Harper is running for City Council 4th district. The Democrats have yet to select anyone to run against Harper. Charles Langley set down as the Democratic candidate running against Harper. However, in the wing, is another potential candidate, Leslie Raymer that could run against Harper. Nevertheless, neitherKevin Knuth nor the Democratic Party have yet to ask her to run.

Harrison Square Park is definitive

The Fort Wayne Redevelopment Dream Team have come to agreements in the signing of each of their agreement with the City of Fort Wayne. The Dream Team consist of Jason Freier, Chief Executive Officer for Hardball Capital, for Hardball Capital and Barry Real Estate, Deno Yiankes, President and CEo for White Lodging Services Investments and Development, and David Ong, President of Acquest Realty, who played a major role in the private/public partnership.

City Council approval is not needed, all papers are signed. The issue of competitive bidding is not an issue because of the unique of the position of managing the project.

Harry Potter Release Party at the Allen County Main Public Library

The Allen County Library is sponsoring a Harry Potter Release Party tonight at 900 Library Plaza. A preshow concert by the Ballroom Roustabout will start at 8:00 p.m. and the "Diagon Alley" will start at 9:00 p.m. for the release of the final Harry Potter's book called Harry Potter and the Deathly Hallows. The event is free.

Union Recognition for the Allen County Jail and the Allen County Highway Department

Represesentatives of IBEW were in town today to request the Board of Commissioners of the County of Allen to recognize IBEW Local 723 as the exclusive bargaining agent for hourly employees.

A letter was presented to the Commissioners this morning by Bruce Getts, Business Manager who represents IBEW Local 723 throughout Indiana including Verizon workers. Also present at the meeting was David L. Schimmel, International Lead Organizer membership Devlopment and C.J. King, Regional Organizing Coordinator membership Development.

In spite of the fact that many employees may feel their jobs may be threaten my joining a union approximately 70% of the hourly employees of the highway department and around 60% of the hourly employees of the jail have signed cards for the purpose of collective bargaining impacting the conditions of their employment in areas such as wages, hours, and benefits.

The committee of Allen County Employee Association President Mike Mills and Board Member Olden Ray are members of group consisting of over 300 members.

Getts suggests that the recent comment by Commission Nelson Peters in the reduction of highway workers will not impact service may not be exact. Getts suggests that private contractors may be hired to replace the displaced workers.

Judge Patrick Sullivan retires from Indiana Court of Appeals

Judge Patrick Sullivan will conclude a 38-year tenure on the Indiana Court of Appeals in a retirement ceremony in the Supreme Court courtroom at 3:00 p.m. on Friday, July 20, 2007. Chief Judge John G. Baker will preside. Judge Sullivan’s family, colleagues, former law clerks, and special guests will attend the ceremony, followed by a reception. (Seating is by invitation, but the media is welcome to cover the event.)

Judge Sullivan is the longest-serving judge in Court of Appeals history. He reaches the constitutionally-mandated retirement age of 75 in August, and his last day on the Court of Appeals will be Tuesday, July 31st. He will continue to serve the court and the citizens of Indiana as a senior judge beginning August 1st.

Judge Sullivan was elected to the Indiana Court of Appeals in 1968 and retained on the Court by election in 1972, 1982, 1992 and 2002. He is the only current member of the Court of Appeals to be popularly elected to the court prior to the advent of the retention selection system.

"Before joining the Court of Appeals, Judge Sullivan served as a Deputy Attorney General from 1958 to 1961. From 1961 to 1965, he engaged in the private practice of law with Minton, Mosiman, Sullivan & Johnson in Indianapolis. He was a Senior Commissioner with the Marion County Probate Court from 1963 to 1964 and a judge on the Marion County Civil Trial Court from 1965 to 1969.

A native of Huntington, Indiana, Judge Sullivan served in the United States Navy for two years during the Korean War. He received his bachelor’s degree in 1956 and his law degree, cum laude, in 1958, both from Washington and Lee University in Lexington, Virginia.

The Indiana Court of Appeals is the state’s second-highest court. It reviews appeals from trial court decisions; a decision of the Indiana Court of Appeals is final unless granted further review by the Indiana Supreme Court. The majority of appeals filed in Indiana are decided by the Court of Appeals."

Governor Mitch Daniels selected Judge Cale Bradford of the Marion Superior Court to take Judge Sullivan’s seat on the court, from the Indiana Court Website.

Well, local government has stated over and over again, that tax bills will soon be in the mail. Folks in Fort Wayne are still waiting on their tax bill. Read what happened to the home a family who did not receive their tax bill. The bill was for only $1.63, but that did not prevent the family from losing their home.

Fort Wayne The Governor is listening

Many property homeowners don't believe anything can be done about the unfair tax burden placed on them in this recent assessment. They are wrong, so says Governor Mitch Daniels. Gov. Daniels is placing a freeze on Marion tax back to the 2006 assessment. And the Gov. Daniels has other suggestion for local government. Extended by two months the deadline for counties to decide to use other available revenue tools to help them reduce local property taxes. Legislation enacted this year gives counties the authority to adopt local option income taxes. The August 1 deadline has been moved to October 1.
· Directed the Department of Local Government Finance (DLGF) to approve any county's application to permit homeowners to pay their property taxes in installments and to extend bill due dates.
· Directed the Indiana Bond Bank to facilitate short-term financing by local governments that need cash while awaiting installments.
But guess what, Fort Wayne is delaying the tax bill as a solution to the propblem.

Tax Day-and the Governor is hot-ain't no waiting till 2008

The resident are slow to response to the shaky business of local official in assessing their property, but the Governor Mitch Daniels knows what's up.

While Daniels chastised lawmakers -- particularly House Speaker B. Patrick Bauer, D-South Bend, and Rep. Win Moses, D-Fort Wayne -- for suggesting that the state's surpluses could be tapped to provide some property tax relief, the governor said he is open to using the surplus temporarily, while the state awaits the $300 million in licensing fees being paid by the two horse-racing tracks in order to install slot machines. The legislature has earmarked those fees for property tax relief.

"I'm open to using part of our hard-won state surplus at least in a temporary way if need be," he said. "But the first thing we should do is use the money already provided by the General Assembly in a more targeted way."

Hispanic Leadership Coalition of Northeast Indiana July 16, 2007 meeting

The Hispanic Leadership Grassroot Development Program held another one of their summer session meetings on July 16, 2007. The meeting was about cultural diversity. Gerald Foday, Executive Director, of the Fort Wayne Metropolitan Human Relation was one of the featured speaker.

Some students attended the meeting who were interested in scholarships to reduce the cost of attending college. The program passed out application for six scholarship worth $500 a piece. The Scholarships are called BECA HLCNI and are renewable for up to a total of four successive semesters as long as all eligibility requirements continue to be met.

Latino/Hispanic and first generation college students who will be attending or currently are attending any of the colleges and universities in the City of Fort Wayne who meet the criteria listed below are strongly encouraged to apply for the "BECA HLCNI." The deadline for applying for the grant is July 31, 2007. Governor Mitch Daniels sent a letter today to legislative leaders that offers two proposals for targeted property taxpayer relief: use of a credit instead of a rebate and local circuit breakers. The letter and proposals are below.

The governor recently has taken several actions within his authority to help reduce local property taxes. Among those actions, the governor:

*Extended by two months the deadline for counties to decide to use other available revenue tools to help them reduce local property taxes. Legislation enacted this year gives counties the authority to adopt local option income taxes. The August 1 deadline has been moved to October 1.

*Directed the Department of Local Government Finance (DLGF) to approve any county's application to permit homeowners to pay their property taxes in installments and to extend bill due dates.

*Directed the Indiana Bond Bank to facilitate short-term financing by local governments that need cash while awaiting installments.

*Ordered the DLGF to further analyze commercial and industrial parcel data for Marion County to determine if assessments between residential and commercial properties are fair or if a reassessment for Marion County will be ordered.

In recent days, some Hoosiers have received property tax bills with increases that are simply unacceptable. Throughout the week, I’ve taken actions within my authority to begin to assist those localities that are experiencing problems.

I said I was formulating some ideas that would need action by the General Assembly, and I’ve been discussing them with a number of people this week. Today, I offer for your consideration two broad proposals for targeted property tax relief that incorporate maximum flexibility for counties. The property tax increases that some are experiencing are highly localized, and there isn’t a one size fits all answer. I believe taxpayers and their locally elected representatives are in the best position to determine the relief plan that most fits their needs.

First, we could give each county the ability to use its share of the $300 million appropriated for property tax relief in this fiscal year as it sees fit. In essence, we would create local circuit breakers. For example, with the estimated $45 million that Marion County will receive as its share of the relief, the county could limit homeowners’ tax bills to approximately 1.6 percent of gross assessed value. Howard County, for example, could use its estimated share of about $4.4 million to limit bills to 1.1 percent.

Second, in the interest of speed and economy, we might consider changing the current rebate plan that would deliver a check months after bills are due to an immediate credit against this year’s tax bill.

You’ll find a description of these ideas on the attached page. Of course, we’re always open to other ideas. I know the Indiana Commission on State Tax and Financing Policy, chaired by Senator Kenley, plans a property tax hearing on July 23 to hear from Marion County taxpayers, so I wanted to get additional ideas into the discussion. 2007 Tax Bill late for the 2008 Tax Sale

Yes folks Robert Lee, better known as Bob, the appointed Allen County Treasurer is getting ready for the 2008 tax sale. The 2005 tax sale had over four thousand properties for sell. Many investors came in from out of town to purchase Fort Wayne properties.


Robert Lee was very happy.

The tax sales of property is cheaper than taking property under eminent domain for economic development. Lee, the treasurer, knows that by October, 2008, the new bill will be due in 2008 and will be mailed out close to August 2008. This will push many folks properties on the tax sale list. If they do not get their property off the tax sale list, before a certain date these folks will have to pay another fee of about $495.00 including an administrative fee.

IC 6-1.1-24 and 25 are the statutes governing the sale of real property for delinquent taxes and/or special assessments
at public auction or tax sale. Although there are unfortunate circumstances which may result in some properties being
offered for sale, it is nonetheless required that all properties with delinquent real estate taxes, penalties, and special assessment liens for unpaid sewer user charges, delinquent weed fees, delinquent Neighborhood Code Order fees, delinquent economic development, or delinquent Barrett Law contracts, as specified by law, be auctioned at the Treasurer’s Tax Sale.


Pretty good racket huh? And Police Chief York are trying to find gang members on the streets!

GOP Meeting

How much you want to bet that the GOP meeting today was more about property taxes than about a golf outing scheduled for August? I don't know for sure, but I did see Lisbeth Blosser, the County Auditor leaving the building a little before 1:30 p.m.

I figured that Blosser was there practicing her on air interview to explain why taxpayers did not get their tax bills on the July 16, 2007. I talked to someone in the treasurer office that told me that the tax bills would not be mailed out until July 18, 2007 on a Wednesday.

But the delay in the mailing of the tax bill did not keep me from letting the folks know that their property taxes have gone wild !! Of course they will know this themselves when the tax bills are mailed. One lady paid half her tax bill today, and told the person collecting the money that she hadn't gotten her tax bill in the mail, yet. It's coming the lady was told.

The city and county does not want the same type of uproar that is occurring in Indianapolis, but lady its coming!!!

Deal or no deal

I received a call from Wayne Township Assessor office two hours after calling into WOWO morning show. I happened to be in the doctor office. About an hour later I was in the assessor office.

They wanted to come in an remeasure my basement, at appeared that the number did not add up. I told them to add them up and put the correct number on the property record card. And explained that it was an administrative error that could be done without coming out.

They suggested that it would reduce my tax bill. What a joke, the number was so small it would not make a difference. When I explained that trending was the reason given for my increase I was told that they could reduce my assessment by $7,000, again I told them go ahead. But no this time I had to sign a paper saying I agreed to change the condition of my home. Again I reminded them I did not have to sign anything, because again this was their administrative error. Again that trending was the reason given for the increase in my property value was the excuse that they gave.

I did not file a complaint, this phone call was to shut me up. It was to look as if they are doing me a favor. May I say once and for all, that the assessment is illegal for all residents, so fix it.

P.S. I received a letter in the mail the next day to appear before the PTBOA. Once again I did not request this, but the assessor what to appear like they are working with me, instead of correcting what they will have to correct before it is all said and done.

I will continue to protest at 12:00 p.m. in front of Freimann Square until they correct the other homeowners they have overassessed just for the heck of it.
